Four of family fined Rs 1L for wasting court’s time

CHENNAI: The Madras high court has imposed a cost of 1 lakh on four of a family for wasting time of the court.

They had challenged the acquisition of their lands under the Land Ceiling Act, six years after the entire proceedings had been completed.

A bench, dismissing the writ appeal of R Saraswathi and three others of Coimbatore, said the acquisition of lands at Saravanampatti had been questioned and incorrect details given by them in view of the escalation of land prices in the region.

The acquisition proceedings were intitiated in 1992 and the land was taken over in 1999, after issuing necessary notice to the head of the family who did not appeal against the acquisition. The writ proceedings were initiated only in 2005. After a single judge dismissed the plea through a detailed order, the present writ appeal was preferred by the legal heirs of the land owner claiming that it was taken over without any notice.

Justice Elipe Dharma Rao, writing the judgment for the bench, said: "It is crystal clear that the attempt of the appellants was to give life to a dead proceeding."
